The commercial terms that apply to 4invest customers.

Service means the 4invest platform and any related onboarding, support, and integration services provided under an Order Form.

Customer means the organization that signs the Order Form. Authorized Users are the customer's employees and contractors with assigned workspace accounts.

Customer Data is the content the customer or its authorized users submit to the service.

4invest grants the customer a non-exclusive, non-transferable right to access and use the service during the subscription term for the customer's internal real-estate operations, within the package and seat count purchased.

The customer is responsible for the actions of its authorized users and for keeping login credentials secure.

Fees are set out in the Order Form. Subscriptions auto-renew for the same term unless either party gives at least 30 days' notice. Annual prepay fees are non-refundable except where explicitly stated.

Late payments accrue interest at the lesser of 1.5% per month or the maximum allowed by law. 4invest may suspend service after 30 days of non-payment with written notice.

Customer Data remains the property of the customer. 4invest is granted a limited right to host, process, and display Customer Data solely as needed to provide the service.

Processing of personal data within Customer Data is governed by the Data Processing Addendum.

4invest retains all rights in the service, its software, the look-and-feel of the workspace, and any feedback or suggestions submitted by the customer (which the customer hereby assigns to 4invest, royalty-free).

Customer marks displayed inside the workspace remain the customer's property; 4invest may reference the customer's name and logo in a customer list with prior written permission.

4invest will use commercially reasonable efforts to make the service available with a target monthly uptime of 99.5% (excluding scheduled maintenance and force majeure). Status and historical incidents are published at status.4invest.co.

EXCEPT AS EXPRESSLY SET OUT, THE SERVICE IS PROVIDED "AS IS" AND 4INVEST DISCLAIMS ALL IMPLIED WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

To the extent permitted by law, the aggregate liability of either party arising out of or related to these terms shall not exceed the fees paid by the customer in the twelve months preceding the event giving rise to the claim.

Neither party is liable for indirect, incidental, consequential, or special damages, except where local law does not permit such exclusion.

Either party may terminate for material breach not cured within 30 days of written notice. On termination, the customer may export Customer Data for 30 days after which 4invest will delete it from production systems within 60 days, subject to legal hold and the audit-log retention noted in the Privacy Policy.

For customers headquartered in the EU/UK, EEA, or Switzerland, governing law is the Republic of Cyprus and disputes are subject to the courts of Limassol.

For customers headquartered in the United States, governing law is the State of Delaware. For customers in the GCC or APAC, parties may agree on alternative seats in the Order Form.
